1. Acceptance of Terms

By accessing or using Viralyze ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

2. Description of Service

Viralyze is a web application that uses AI and APIs to generate social media captions, hashtags, and virality scores. Users can post content to selected platforms and track performance using our tools. Direct posting is available for Instagram, Facebook, and LinkedIn; manual posting is used for TikTok and Twitter/X.

3. Eligibility and Account Responsibility

You must be at least 18 years old and capable of forming a binding contract to use Viralyze. You are responsible for your account activity, keeping your credentials secure, and complying with all applicable laws.

4. User Content and Platform Compliance

You retain ownership of your content but grant Viralyze a license to use it solely to deliver the Service. You are solely responsible for ensuring your content complies with the terms and community guidelines of the social media platforms you use.

5. API Access and Platform Terms

Our Service relies on APIs provided by third parties (Meta, LinkedIn, etc.). These APIs may change or be revoked at any time, which may impact service availability. We do not guarantee continuous access to these integrations.

6. Privacy and Data Use

Your data is processed according to our Privacy Policy. Data is retained for up to 24 months unless longer retention is required by law or for technical reasons.

7. Limitation of Liability

To the fullest extent permitted by Missouri and U.S. law, Viralyze, Mohamud Abdi, and affiliates disclaim all liability for damages resulting from your use of the Service, including loss of data, revenue, or reputation.

8. Indemnification

You agree to indemnify and hold harmless Viralyze, Mohamud Abdi, and associated personnel against any claims or liabilities arising out of your use of the Service or violation of these Terms.

9. Payment & Refund Policy

All payments are processed via Stripe. Subscription charges are billed in advance and are non-refundable unless required by law. You are responsible for canceling your subscription before renewal. We reserve the right to change pricing with reasonable notice.

10. Payment Processing

We use Stripe as our secure payment processor. By making a payment, you agree to Stripe's Terms and Privacy Policy. Viralyze does not store or process full payment information directly.

11. Copyright Compliance

You may not upload, post, or use content that infringes on third-party intellectual property. We comply with the DMCA and respond to takedown notices at: viralyze5@gmail.com.
